ScoreItUp terms and conditions
This agreement between ScoreItUp LLC (“ScoreItUp”) and Student includes all of the following terms and conditions:
1. LESSONS AND INSTRUCTOR GUARANTEE: All in-person, live online, and video lessons will be taught by Mark Sacks. The content of lessons and mock exams shall be determined solely by ScoreItUp.
2. ONLINE ACCESS (IN-PERSON AND LIVE ONLINE COURSES): Students will have access to ScoreItUp’s confidential and proprietary online materials (videos, texts, and live course recordings) from the start of their course through the date specified in the course offering (typically the official LSAT date immediately following the final class). Extensions may be arranged by email with ScoreItUp; additional fees may apply.
3. ONLINE ACCESS (SELF-PACED COURSES): Students in self-paced courses will have access to online materials for the duration of the course, starting from when the student receives a username and password. Extensions may be arranged via email with ScoreItUp; additional fees may apply.
4. MISUSE OF SCOREITUP’S INTELLECTUAL PROPERTY: Students agree not to sell, loan, copy, reproduce, or distribute ScoreItUp materials in any form, electronic or otherwise. Students may not use ScoreItUp materials for tutoring or teaching LSAT prep to others.
5. MISUSE OF SCOREITUP COURSE: Students represent that they are taking the course solely to improve their own LSAT score and are not acting on behalf of, or in any capacity for, any other test prep company. Student will not use ScoreItUp materials to assist any other LSAT prep business.
6. ABUSIVE CLASSROOM BEHAVIOR: Students in live or live online courses must conduct themselves reasonably and respectfully. ScoreItUp may prohibit attendance for behavior deemed unreasonably disruptive, offensive, or unacceptable.
7. BREACH OF AGREEMENT: If a student breaches any term of this agreement, ScoreItUp may terminate participation and revoke access to materials. Refunds are at ScoreItUp’s sole discretion. This does not limit any legal rights ScoreItUp may have, including protection of intellectual property.
8. ATTORNEYS’ FEES: Disputes are governed by California law. The losing party shall be responsible for all attorney’s fees and costs of the prevailing party.
9. REFUNDS:
a. Students in ScoreItUp’s in person or live online courses may cancel at least one week before the first class to receive a full refund.
b. No refund will be issued after student has requested a password for online access, except as described in Paragraphs 10 and 12.
c. Refunds will be issued within 30 days of written notice, unless there is good cause to delay.
10. HIGHER SCORE GUARANTEE: Students in live courses may qualify for their choice of one of the following (not both):
(a) a full refund, or
(b) a free repeat course
To qualify for the Higher Score Guarantee, all of the following conditions must be met:
a. Email ScoreItUp at mark@scoreitup.com prior to the course with your official LSAT score report attached.
b. Retake the official LSAT within 90 days after your final class.
c. If you do not achieve a higher score, email your updated official LSAT score report to ScoreItUp at mark@scoreitup.com within 90 days of your LSAT retake date and request a refund or repeat course.
d. You must be taking a ScoreItUp in person or live online course for the first time.
e. Providing ScoreItUp with knowingly false LSAT information constitutes fraud and may result in legal action.
f. If ScoreItUp’s “matching” higher score guarantee applies, terms must be set in a written email from ScoreItUp to Student.
[NOTE: The simple summary of the Higher Score Guarantee terms above is that you are entitled to either a refund or repeat course if you (1) took the LSAT before ScoreItUp’s course, (2) took the LSAT again after ScoreItUp’s course, (3) did not increase your LSAT score, and (4) provided ScoreItUp with timely written notices of your score reports.]
11. RIGHT TO DENY ENROLLMENT: ScoreItUp may deny enrollment at its sole discretion for any lawful reason. Refunds will be issued unless the student has breached this agreement.
12. STUDENT ACKNOWLEDGMENTS AND AGREEMENTS:
a. Student has read and agrees to all terms.
b. Except as in Paragraph 10, ScoreItUp makes no representations or guarantees about LSAT scores or performance.
c. This Agreement represents the sole understanding; no other representations are relied upon.
d. Classes or locations may change or be canceled. Full refunds apply if no mutually agreed makeup is arranged.
e. If a course meeting is canceled without a makeup within four weeks, a pro-rata refund will be issued.
f. Student has had the opportunity to review and edit this Agreement.
g. If any part is void, the rest remains in effect.
